Terms of Service
TattooMaker terms of service: accounts, credits, the 7-Day Pass and subscriptions, renewals and cancellation, refunds, AI-generated designs and acceptable use.
Last updated: 2026-10-05
1. About these Terms
TattooMaker is operated by Chen Zhe, an individual based in the People’s Republic of China (“TattooMaker”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your use of the AI tattoo design service at tattoomaker.org, including the AI tattoo generator, HD refinement, photo to tattoo, cover-up and AI try-on tools, and the in-browser tools such as the stencil maker, try-on and font generator (the “Service”).
By creating an account, buying a pass, subscribing to a plan or otherwise using the Service, you agree to these Terms, our Acceptable Use Policy and our Privacy Policy. If you don’t agree, please don’t use the Service.
You must be at least 18 years old to create an account or make a purchase. Previews in the in-browser tools can be used without an account.
2. The Service
TattooMaker generates original tattoo design concepts with AI and provides tools to refine them, preview them on skin and turn them into stencils. The Service is a digital, intangible product delivered online: access to paid features and credits is granted as soon as your payment is confirmed.
The AI features use third-party image models — currently Seedream 5.0 Flash (ByteDance) and GPT Image 2 (OpenAI), with Gemini Flash (Google) for safety review — accessed through their providers’ APIs; see AI models we use. You choose the model for each run. Their availability can affect ours, and we may change the models we use. TattooMaker is independent and not affiliated with or endorsed by these providers.
3. Your account
You need an account to use the AI features. Keep your login secure, keep your email address up to date and tell us at once at support@tattoomaker.org if you suspect someone else is using your account. You are responsible for activity on your account.
4. Credits, passes and plans
AI features are paid for with credits. The price depends on the action and the model you choose (the full table is on our pricing page):
- Sketch run (four AI sketches): 1 credit on Seedream 5.0 Flash, 3 credits on GPT Image 2 at 2K, 5 credits on GPT Image 2 at 4K.
- HD redraw of one design with GPT Image 2: 1 credit at 2K, 2 credits at 4K.
- Photo to tattoo, cover-up or AI try-on run (two results): 1, 2 or 3 credits for Seedream 5.0 Flash, GPT Image 2 2K or 4K.
- Download or print of a file from an in-browser tool (fonts, lettering, stencil, try-on, printable sheets and others): 1 credit per file. Previews are free, and downloading the same file again within 24 hours is free. Downloading designs you generated with AI is included in their generation cost.
New accounts with a verified email receive 1 free welcome credit, valid for 30 days, which can be used with the Seedream 5.0 Flash model only. GPT Image 2 can be used with credits from any purchase. You get more credits from the products on our pricing page:
- 7-Day Pass — $7.99, a one-time purchase of 40 credits that can be used for 7 days. It never renews.
- Credit top-up — $4.99, a one-time purchase of 20 credits that can be used for 30 days.
- Pro — $12.99 a month for 80 credits each month, or $119 a year for 960 credits for the year.
- Artist — $29.99 a month for 220 credits each month and a commercial license.
Credits have no cash value, can’t be transferred or sold and are used only on TattooMaker. Credits that expire soonest are used first. Credits from a subscription expire at the end of the billing period they belong to and don’t roll over. Credits from a one-time purchase keep their own validity period whether or not you also have a subscription.
If a generation fails, is filtered by our safety checks or never produces an image, the credits for it are returned automatically.
5. Payment and billing
Our order process is conducted by our online reseller Waffo Pancake, the Merchant of Record for all our orders. Waffo processes your payment, calculates and collects any sales tax or VAT that applies, issues your receipt and handles payment-related questions and refunds. Your card details are handled by Waffo and never stored on our servers.
Prices are shown in US dollars on our pricing page before you check out. Any applicable tax is shown at checkout.
Recurring billing. When you subscribe to Pro or Artist you authorise Waffo, on our behalf, to charge your payment method at the start of every billing period (monthly or yearly, as you chose) at the price shown when you subscribed, until you cancel. We’ll tell you in advance of any price change, and you can cancel before it takes effect.
One-time purchases. The 7-Day Pass and credit top-ups are charged once and never renew.
6. Cancelling a subscription
You can cancel at any time from Settings → Billing → Cancel subscription, or by emailing support@tattoomaker.org. Cancellation takes effect at the end of the current billing period: you keep access and your remaining credits for that period, and you won’t be charged again. Credits from one-time purchases are not affected.
7. Refunds
- 7-Day Pass and other one-time purchases — if you haven’t used any of the credits, you can get a full refund within 7 days of purchase. Credits that have been used are non-refundable.
- Subscriptions — if you’re subscribing for the first time, you can get a full refund within 7 days of your first payment as long as you’ve used fewer than 20% of that period’s credits. Renewals are refundable within 7 days if you haven’t used any credits from the new period.
- Billing errors — duplicate charges, or a service outage that keeps you from using paid features for 72 hours or more, are refunded or credited.
To ask for a refund, email support@tattoomaker.org from your account email with your receipt or order number. We reply within 2 business days, and approved refunds are issued by Waffo to your original payment method. When a purchase is refunded, its remaining credits are removed. If you think a charge is wrong, please contact us before disputing it with your bank so we can fix it quickly.
8. Your designs and AI output
Who owns what. As between you and us, you own the designs you generate (“Outputs”), subject to these Terms and to any rights of third parties. Because designs are made by AI, they may not be protected by copyright in every country, and similar designs may be generated for other people.
How you may use them. On any plan you may use your designs for your own tattoos — including having any artist tattoo them for you. Selling designs, offering them as flash, or printing them on merchandise requires an active Artist plan, which includes a commercial license for designs made during the subscription.
AI-generated content. Every design is generated by AI and labelled as such. Don’t present a design as hand-drawn human work where that would mislead someone, for example when selling it. Treat every design as a starting point: a professional tattoo artist should adapt it to your body and check it before tattooing.
What you give us. You keep ownership of the prompts and photos you submit (“Inputs”). You give us a limited license to process them only to provide the Service. We don’t use your Inputs or Outputs to train AI models. Uploaded photos are deleted automatically within 24 hours.
Our content. The TattooMaker website, gallery images, fonts, tools and software are owned by us or our licensors and may not be copied except as these Terms allow.
9. Acceptable use
You must follow our Acceptable Use Policy. In short, you may not use the Service to create or upload sexual or nude content, anything that sexualises or endangers children, gore or self-harm imagery, hate content, the likeness of real people or deepfakes, or content that infringes copyright or trademarks — and you may not try to get around our safety checks, scrape or resell the Service, or use it to train competing AI models. We moderate prompts, uploads and outputs, and we may block requests, remove content, pause or suspend accounts and forfeit credits for serious violations, as described in that Policy.
10. Privacy
Our Privacy Policy explains what we collect and why. If you ask us to delete your account, we delete your account data within 90 days, except where we must keep records by law (for example, purchase and moderation records).
11. Disclaimers and liability
The Service is provided “as is” and “as available”. AI output can be unexpected, inaccurate or unsuitable, and we don’t guarantee any particular result. A tattoo is permanent: decisions about a tattoo, its design, size, placement and the artist you choose are yours.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits rights you have under consumer protection laws that can’t be excluded.
12. Breach, suspension and termination
Term. These Terms apply from the moment you first use the Service and for as long as you use it or have an account.
If you break these Terms. If you breach these Terms or our Acceptable Use Policy, we may, depending on how serious and how repeated the breach is:
- block the request and remove the content involved;
- pause AI features on your account (repeated blocked requests pause them automatically for 24 hours);
- suspend your account while we investigate;
- permanently close your account.
For serious breaches — including anything involving child sexual abuse material, sexual content involving real people, attempts to defraud us or other users, chargeback fraud, or deliberately getting around our safety systems — we may close your account immediately and without prior notice. In that case remaining credits are forfeited and paid amounts are not refunded, any active subscription is cancelled, and we may report the matter to the authorities. You remain responsible for any loss you cause by the breach.
Closing for other reasons. You can stop using the Service and close your account at any time by emailing support@tattoomaker.org; cancel any subscription first (Section 6). If we close your account or stop the Service for a reason other than your breach, we’ll give you reasonable notice where possible and refund the unused part of any prepaid period and the value of unused purchased credits.
Appeals. If you think an action was a mistake, email support@tattoomaker.org within 30 days; someone not involved in the original decision will review it within 10 business days.
What continues after termination. Sections 7 (Refunds, for purchases made before termination), 8 (Your designs and AI output), 11 (Disclaimers and liability), 12 (this section) and 14 (Governing law and disputes) continue to apply after your account is closed. Designs you downloaded remain yours to use under Section 8.
13. Changes
We may update these Terms. We’ll post the new version here with a new date and announce material changes on the site at least 14 days before they take effect. Continuing to use the Service after that means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the People’s Republic of China. Please contact us first at support@tattoomaker.org — most issues can be solved quickly that way, and we reply within 2 business days. If a dispute can’t be resolved informally within 30 days, it will be submitted to the competent people’s court at the place where TattooMaker’s operator resides. Nothing in these Terms takes away mandatory consumer rights you have under the law of the country where you live. If any part of these Terms is found unenforceable, the rest stays in effect.
